New Jersey Divorce Laws

New Jersey allows for both fault-based and no-fault divorces. Contested vs. Uncontested Divorce in New Jersey

There are two main types of divorce in New Jersey: contested and uncontested divorce. 

A contested divorce occurs when spouses cannot agree on one or more significant issues related to their divorce, such as child custody, division of assets, alimony, or child support. On the other hand, an uncontested divorce occurs when both spouses agree on all the key issues related to their divorce.

In a contested divorce, the parties may engage in litigation and court proceedings to resolve the issues. This often involves legal representation, hearings, and potentially a trial where a judge makes decisions on the unresolved matters.

Contested divorces typically take longer to resolve due to the need for court involvement, legal proceedings, and potential negotiations or trials. They may also involve higher legal fees due to increased time and resources spent on the case.

In an uncontested divorce, both spouses work together to reach a mutually acceptable agreement on all aspects of the divorce. This agreement is usually documented in a settlement agreement, which is then presented to the court for approval.

Uncontested divorces tend to be quicker and more cost-effective compared to contested divorces. Since there is no need for court battles or extensive negotiations, the process can be streamlined. However, the timeline can still vary based on court schedules and the completeness of the agreement.
