How Do You Get Custody of a Child in Morris County?

In New Jersey, parents can have joint custody or one parent can have sole custody. Parents can also have joint legal custody and one parent can have sole physical custody. When deciding whether parents will have joint custody or one parent will have sole custody, the court will consider the best interests of the child.

Some factors the court may consider when determining child custody include:

  • The child's relationship with each parent
  • The child's relationship with their siblings
  • The child's needs and safety
  • The child's preference (if they are old enough)
  • The stability of each parent's home
  • The parents' ability to communicate and cooperate with each other
  • Any history of domestic violence

What Is the Child Custody Process in NJ?

When parents cannot agree on a child custody arrangement, they will need to go to court and have a judge decide.

Here is a general overview of the Morris County, NJ child custody process:

  • File a complaint: The first step in getting a child custody order is filing a complaint with the court. The complaint will state the child custody arrangement you are requesting and the reasons why you believe it is in the best interests of the child. If you are filing for a child custody order as part of a divorce, you will include the complaint in your divorce papers.
  • Go to court: Once you have filed a complaint, you will have to go to court and present your case. The court will consider the best interests of the child when making a child custody decision. You will have to present evidence that your proposed child custody arrangement is in the child's best interests. You will also have to present evidence that you are a good and fit parent. The court may consider the child's wishes if they are old enough to express a preference. The court may also order a custody evaluation, which is an investigation into the child's living situation and the child's relationship with each parent.
  • Receive a child custody order: After you have gone to court, the judge will make a child custody decision in writing. The judge may grant your requested child custody arrangement, grant a different child custody arrangement, or deny your request for a child custody order. If the judge grants your requested custody arrangement or grants a different arrangement, they will issue a corresponding child custody order. If the judge denies your request for a child custody order, they will issue an order stating that the current child custody arrangement will remain in effect.
